does anyone know of a professional boiler tester not related to the hobby who can examine and write a report on its suitability for the purpose it was made for depite having a CE mark

I believe you would need someone connected to this hobby, so that they can form a valid opinion. At the same time, it shouldnt be someone who makes boilers, and it would need to be someone who has the requisite qualifications.
I wonder if someone such as, for example, the SMEE could be asked to nominate someone suitable?
A professional boiler inspector, of whom there are several, could easily examine and test a boiler, but as most deal with larger steel boilers, may not be as familiar with the small copper ones. But, it is another avenue that could be worth exploring.

I do not know where you live but you could also contact the local Model Engineering Society Federation and ask them about authorised club based boiler inspectors. At least that way you will have a randomly chosen inspector, who will only repeat any hydraulic testing and confirm whether or not it passed.

Photographs will only show the cosmetic side, I have seen awful boilers which have worked without problems and also the most beautiful, with all the "spare" solder removed which also makes me wonder why that was done as it takes a lot of time.
It is not a matter of being "legal", if you have had it tested and it passed hydraulically with the Certificate then that is it! (Excepting the later in steam test) If it was professionally made and it is CE marked and with its Certificate then that is also it! With a certificate the insurers will cover public use, if for private use then you do not need a certificate except for peace of mind.
If any further work has been done on it after testing then that may invalidate the test, ask an Inspector at your club.

your boiler can be tested by smee or name , but it can also be tested by a insurance company tester such as Zurich if you can afford it
